Terms of Service.

1. Who We Are

Watermelon Ghost Inc. is a Delaware corporation (“WG,” “we,” “us”). We provide Generative Engine Optimization (GEO) intelligence services — auditing how brands appear across AI platforms and delivering actionable improvement blueprints.

By purchasing any WG service or checking the “I agree to the Terms of Service” box at checkout, you (“Client,” “you”) agree to these Terms in full.

2. Our Services

We offer two products. The terms in Sections 3 and 4 clarify where they differ. All other sections apply to both.

Quarterly GEO Intelligence Subscription — $900/quarter

One-Time GEO Audit — $1,800

Full audit as described above — single delivery, no ongoing tracking or re-scoring

3. Delivery & Strategy Calls

Following receipt of your completed intake form, we will contact you within 72 business hours (Monday–Friday, excluding public holidays) to schedule your strategy call. Your strategy call — and report delivery — can take place as soon as within that same 72 business hour window. Your audit report will be delivered at the time of your strategy call. You are responsible for scheduling your strategy call in a timely manner; delays in scheduling will affect your report delivery date.

Delivery is to the email address provided at checkout. You are responsible for ensuring that address is accurate and monitored. If delivery fails due to an invalid or unmonitored address provided by you, the 72-hour refund window does not apply. If delivery fails for any other reason, contact us at georgina@watermelonghost.com within 5 business days and we will re-deliver at no charge.

4. Payment, Cancellation & Refunds

Subscription — Annual Commitment, Billed Quarterly

The Quarterly GEO Intelligence Subscription is a 12-month service commitment, billed in quarterly instalments of $900 USD via Stripe. Your first payment begins your annual term; each subsequent charge occurs automatically every 3 months for the duration of that term.

Because your GEO Visibility Score, competitive benchmarking, and blueprint are designed to compound in value over consecutive quarters — each cycle builds on the data and progress from the last — the subscription is structured as a full annual commitment rather than a quarter-to-quarter service.

Term length: 12 months from your first payment date (4 quarterly billing cycles).
During the term: Quarterly payments are non-cancellable and non-refundable once each billing cycle has begun, except as provided under the 72-hour delivery guarantee below.
Renewal: At the end of your 12-month term, your subscription renews automatically for an additional 12-month term unless you cancel at least 30 days before your renewal date.
Cancellation: You may cancel at any time to stop renewal into a new term. Cancellation requests take effect at the end of your current 12-month term and do not entitle you to a refund of quarters already billed or in progress.
Refund window: If your audit report for any given quarter has not been delivered within 72 business hours of your completed intake form for that quarter, you are entitled to a full refund of that quarter’s payment only.

One-Time Audit

Billed as a single charge of $1,800 USD via Stripe at time of purchase.

This is a single, standalone purchase — not a subscription and not a recurring commitment.
Refund window: If your audit report has not been delivered within 72 business hours of your completed intake form, you are entitled to a full refund.
No cancellation applies, as there is no future billing to cancel.

5. Scope — What Is Not Included

WG is an advisory-only service. We diagnose and prescribe; your team (or your agency) implements. The following are explicitly outside scope for both products:

Content creation, copywriting, or blog writing
Website development or technical implementation of any kind
SEO campaign management or paid media
Execution of blueprint recommendations
Ongoing support, consulting, or account management beyond the included strategy call

If you need execution support, we are happy to recommend content and implementation partners.

6. No Performance Guarantees

AI platforms (ChatGPT, Claude, Perplexity, Google AI) use probabilistic, continuously updated systems that are outside our control. WG does not guarantee specific citation frequency, mention rates, ranking positions, traffic, bookings, or revenue outcomes.

Our blueprints represent best-practice recommendations based on observed AI behaviour and our proprietary methodology. Results vary by property, competitive market, content quality, and implementation. Improvement in GEO visibility score requires consistent action on the blueprint by your team.

7. Intellectual Property

WG retains ownership of all methodologies, frameworks, scoring systems, and proprietary processes, including the 4 Decision Moments framework and all underlying audit technology. “Search in Revolt” and related content remain the intellectual property of WG.

Upon payment, you receive a limited, non-exclusive licence to use your delivered reports and blueprints for your own internal business purposes. You may not resell, sublicense, or redistribute WG deliverables without written consent.

8. Confidentiality & Data Use

We treat your property data and business information as confidential. We will not share client-identifiable information with third parties without your consent.

We may use anonymised, aggregated data from audits for internal product development, benchmarking, and to improve our methodology. This data is never attributable to your property.

9. Limitation of Liability

To the fullest extent permitted by law, WG’s total liability to you under these Terms is limited to the fees you paid in the 3-month period in which the claim arises. For one-time audit purchases, liability is limited to the single purchase price paid.

WG is not liable for indirect, incidental, consequential, or lost-revenue damages, including lost bookings, lost profits, or business interruption, even if advised of the possibility of such damages. If a delivered report contains a material error, WG’s sole remedy obligation is to re-deliver a corrected report at no charge.

10. Dispute Resolution

In the event of a dispute arising from these Terms or your use of WG services, both parties agree to first attempt resolution through good-faith negotiation. If unresolved within 30 days, disputes will be submitted to binding arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules, with proceedings conducted in Delaware. Nothing in this section prevents either party from seeking injunctive or equitable relief in a court of competent jurisdiction where necessary to protect intellectual property or confidential information.

11. Changes to These Terms

We may update these Terms from time to time. When we do, we will update the effective date at the top of this document. For active subscribers, material changes will be communicated by email with at least 14 days’ notice before taking effect. Continued use of our services after that date constitutes acceptance of the updated Terms.

12. Governing Law

These Terms are governed by the laws of the State of Delaware, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of WG services will be resolved in the courts of the State of Delaware.
